1. Agreement and eligibility
Husano is operated by Ervin Solutions Limited, a company registered in Kenya (company no. PVT-EYUBPQ98). By accessing or using Husano, you agree to these terms and our privacy policy. If you use Husano for a company, landlord or property manager, you confirm that you are authorised to bind that person or organisation.
You must be at least 18 years old and legally able to enter an agreement, or use Husano under the authority and supervision of a person who can. If you do not agree to these terms, do not use the service.
2. What Husano does
Husano helps authorised people manage residential properties. It can maintain property and occupancy records, calculate or present bills, record meter readings, track payments, support maintenance requests and give landlords a dashboard overview. Staff and tenants can also choose to receive relevant notifications, including through WhatsApp where available.
Husano is a management tool. Ervin Solutions Limited is not a landlord, tenant, property agent, bank, mobile-money provider or party to a tenancy agreement. We do not own or manage the listed properties, decide the commercial terms of a tenancy or hold rent on behalf of users unless a separate signed agreement expressly says otherwise.
3. Accounts, access and authority
- Provide accurate, current information and keep it up to date.
- Keep passwords, sign-in links, devices and account access secure. Do not share an individual account or use another person’s account.
- Tell us promptly at info@husano.com if access is lost, compromised or no longer authorised.
- Landlords and managers must give each person only the role and property access they need, and remove access when their role ends.
Actions taken through an authenticated account may be treated as authorised until we are told and have had a reasonable opportunity to secure the access.
4. Your responsibilities and acceptable use
You must use Husano lawfully and only for genuine property work. You must not:
- impersonate another person, misrepresent your authority or provide information you know is false or misleading;
- access a property, unit, record or account that you are not authorised to use;
- harass, threaten, discriminate against or unlawfully monitor tenants, caretakers, landlords or other users;
- send spam, malware or unlawful content, or use the service for fraud or to evade a legal obligation;
- probe, disrupt, overload, reverse engineer or bypass Husano’s security or access controls, except where applicable law expressly permits it; or
- copy, scrape, resell or commercially exploit the service or its data without our written permission; or
- use Husano for anything the WhatsApp Business Policy prohibits or restricts, including political campaigning, illegal goods or services, alcohol, tobacco, drugs, weapons, gambling, adult content, lending or multi-level marketing.
You are responsible for checking entries and correcting mistakes, including rent, rates, meter readings, invoices, payment references and occupancy dates. A Husano record does not replace an original receipt, lease or legally required document.
5. Property records and personal data
A landlord or property manager who adds information about tenants, caretakers or other people confirms that they have a lawful basis, have given any required privacy notice and are authorised to instruct Husano to process it. They must answer reasonable questions from those people and help us fulfil valid data-protection requests.
Husano does not require or store national ID or passport numbers. Keep lease identity checks and identity-document copies outside Husano. Do not submit payment PINs, passwords, biometric or health information, or other information that is unnecessary for property management. If you submit content, you grant us the limited right to host, copy, transmit and otherwise process it only as needed to provide, secure and improve the service and meet legal duties.
6. Optional notifications
Notifications are optional for all staff and tenants. Each person can choose whether to receive them and can stop them at any time. Choosing not to receive notifications does not affect an account, role, tenancy, charges or access to Husano. Where a person chooses WhatsApp, Husano uses a WhatsApp Business number and must follow Meta’s WhatsApp Business Policy and messaging guidelines. Everyone who enables or manages those notifications agrees to help Husano do that.
Landlords, property managers and caretakers
- Add a person’s phone number only if they gave it to you for this purpose. Before enabling notifications, tell them that the service is optional, what kinds of updates they may receive from Husano, which channel will be used and how to stop them. Enable notifications only if they agree.
- Confirm that agreement truthfully when Husano asks. A false confirmation is a breach of these terms.
- Use notifications only for genuine information about the property, a person’s role or tenancy, such as bills, payments, reminders, water interruptions, repairs, meetings or rule changes. Never use Husano to send advertising, promotions, offers, referral requests, political messages or content unrelated to the building.
- Respect each person’s choice. Do not re-enable notifications for a person who opted out unless that person asks to receive them again. Reach them through another appropriate means instead.
- Never use a Husano notification or reply to ask for a full payment-card number, bank or other financial account number, PIN, password or identity document.
- Give your tenants a way to reach you directly, and answer the requests Husano passes to you.
Staff, tenants and other recipients
- You choose whether to receive notifications from Husano. If you use WhatsApp, you can opt out at any time by choosing Stop WhatsApp messages in the Husano menu or typing STOP. To opt back in, choose Resume WhatsApp messages or type START.
- Opting out stops optional notifications on that channel only. It does not close your account, change your role, end your tenancy, change what you owe or restrict your access to Husano. A landlord or manager may still contact you by another appropriate means.
- Notifications do not replace direct contact with the people responsible for your property. For personal help, contact your caretaker or property manager, or email info@husano.com.
We may hold, edit or decline to send any notification that we believe breaks these rules or Meta’s policies. We may also restrict notifications for an account that causes complaints or blocks. Meta can limit or remove Husano’s access to WhatsApp, and that can affect that optional notification channel.
7. Billing records and payments
Property owners or managers set the rent, deposits, rates, due dates, payment methods and other charges shown through Husano. They are responsible for ensuring those amounts and instructions are accurate, lawful and consistent with the applicable tenancy agreement.
Payments are processed by the relevant mobile-money, bank or other payment provider. Provider availability, charges, reversals, delays and errors are governed by that provider’s terms. Husano may record a provider callback or a manually confirmed payment, but a status shown in Husano is not a bank statement. Users should report discrepancies promptly and keep provider receipts.
Ervin Solutions Limited does not resolve the underlying merits of a rent, deposit, utility or tenancy dispute. The relevant landlord, manager and tenant remain responsible for resolving it under their agreement and Kenyan law.
8. WhatsApp and other third-party services
Husano works with services operated by others, including WhatsApp and Meta, mobile-money or banking providers, email, hosting and internet services. Their own terms and privacy policies may apply. We are not responsible for a third party’s independent service, content or outage, but we remain responsible for our own obligations when we use a provider to process information on our behalf.
9. Content and intellectual property
You retain ownership of information and content you lawfully provide. Ervin Solutions Limited and its licensors retain all rights in Husano, including the software, design, brand, documentation and service improvements. Subject to these terms and any customer agreement, we give authorised users a limited, non-exclusive, non-transferable and revocable right to use Husano for its intended purpose.
Feedback may be used to improve Husano without restriction or payment, provided we do not publicly identify the person who supplied it without permission.
10. Fees and customer plans
Any subscription fee, billing cycle, included usage, trial or tax will be stated in an order form, invoice or separate customer agreement before charges begin. Unless that agreement says otherwise, fees are due in advance and are non-refundable once the relevant service period begins, except where law requires a refund. We will give reasonable notice of pricing changes before they apply to a later billing period.
11. Changes, maintenance and availability
We may maintain, update or change Husano to improve it, protect users, comply with law or respond to provider changes. We aim to keep the service dependable but do not promise uninterrupted or error-free availability. Planned maintenance and material service changes will be communicated when reasonably practicable.
12. Suspension and termination
You may stop using Husano at any time. A paying customer may cancel as provided in its order form or customer agreement. We may restrict or suspend access where reasonably necessary to address a security risk, unlawful use, material breach, non-payment, harm to another person or a third-party platform requirement. Where appropriate, we will give notice and a reasonable opportunity to correct the issue.
On termination, the right to use Husano ends. We will handle stored information under the privacy policy and any applicable customer agreement. Terms that by their nature should continue—including ownership, accrued payment obligations, disclaimers, liability and dispute provisions—will survive.
13. Disclaimers and limitation of liability
Husano is provided on an “as available” basis. To the extent permitted by law, we do not give implied warranties of uninterrupted operation, fitness for a particular purpose or that every user-entered or provider-supplied record will be accurate. Nothing on Husano is legal, tax, accounting or financial advice.
To the extent permitted by law, Ervin Solutions Limited will not be liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or loss caused by inaccurate user entries, an underlying tenancy dispute, or an independent third-party service. Our total liability arising from a customer account will not exceed the fees paid or payable for that account during the 12 months before the event giving rise to the claim.
These limits do not exclude liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or a breach of mandatory data-protection or consumer rights.
14. Kenyan law and disputes
These terms are governed by the laws of Kenya. Before starting formal proceedings, you and Ervin Solutions Limited will try in good faith to resolve a dispute by written notice and discussion for at least 30 days, unless urgent relief is reasonably needed. If the dispute is not resolved, the courts of Kenya will have jurisdiction, subject to any mandatory right to bring a claim elsewhere.
15. General terms, changes and contact
If a separate signed customer agreement conflicts with these terms, that agreement controls for the conflict. If any part of these terms is unenforceable, the rest remains effective. A delay in enforcing a term is not a waiver. You may not transfer your rights under these terms without our written consent; we may transfer ours as part of a merger, reorganisation or sale of the relevant business, subject to applicable law.
We may update these terms when Husano or the law changes. We will post the new terms here and change the effective date. We will give reasonable notice of a material change where practicable. Continued use after the new terms take effect means you accept them; if you do not, stop using Husano and contact us about closing the account.
